Terms of Service

1. Eligibility and Account Registration

1.1 Age Requirements

You must be at least 13 years of age (or 16 in the EU/EEA) to use GoGlow. If you are under 18, you must have your parent or guardian's permission to use the Service. By using GoGlow, you represent that you meet these age requirements.

1.2 Account Registration

You may use certain features of GoGlow without creating an account. To access the full Service, you may register for an account by providing accurate, complete, and current information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

1.3 Account Responsibility

You agree to: (a) provide accurate registration information; (b) maintain the security of your password; (c) notify us immediately of any unauthorized use; (d) not share your account with others; and (e) accept responsibility for all activities under your account.

2. Acceptable Use

2.1 Permitted Uses

You may use the Service for lawful personal purposes, including creating AI-generated portraits of yourself and sharing them for personal use.

2.2 Prohibited Content

You agree not to upload, generate, share, or otherwise process content that:

• Depicts or suggests sexual content involving minors (CSAM) — this is strictly prohibited and will be reported to law enforcement
• Is pornographic, obscene, or sexually explicit
• Depicts or glorifies violence, self-harm, or hate speech
• Violates the privacy or publicity rights of any individual
• Depicts recognizable individuals (other than yourself) without their explicit consent
• Is defamatory, fraudulent, or intentionally misleading
• Infringes on any third party's intellectual property rights
• Violates any applicable laws or regulations

2.3 Prohibited Actions

You agree not to:

• Use the Service for any commercial purpose without prior written authorization from GoGlow
• Scrape, crawl, or extract data from the Service in an automated manner
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to bypass security measures, content filters, or usage limits
• Create multiple accounts to circumvent restrictions or policies
• Use the Service to develop a competing product or service
• Impersonate any person, entity, or GoGlow
• Engage in any activity that violates applicable export control or sanctions laws

3. User Content

3.1 Your Photos

You retain ownership of photos and images you upload to the Service ("User Content"). You represent and warrant that: (a) you own or have the necessary rights to your User Content; (b) your User Content does not violate any third-party rights; and (c) you have the consent of all identifiable individuals depicted in your User Content.

3.2 License to GoGlow

By uploading User Content, you grant GoGlow a limited, worldwide, royalty-free license to process, analyze, and use your User Content solely for the purpose of providing the AI generation service to you. This license terminates when you delete the content or your account.

3.3 Generated Content

AI-generated portraits created through our Service ("Generated Content") are provided to you under a personal, non-commercial license. You may share Generated Content on personal social media accounts with attribution to GoGlow encouraged but not required. Commercial use of Generated Content requires a separate commercial license from GoGlow.

3.4 Content Moderation

GoGlow reserves the right (but has no obligation) to review, screen, or remove any User Content or Generated Content that violates these Terms, at our sole discretion and without prior notice.

4. Subscriptions and Payments

4.1 Plans

GoGlow offers a free tier and paid subscription plans. Details of each plan, including pricing and included credits, are available within the Application.

4.2 Billing

Paid subscriptions are billed through the Apple App Store or Google Play Store according to the terms of those platforms. By subscribing, you agree to the applicable platform's payment terms.

4.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. Cancellation must occur at least 24 hours before the renewal date to be effective for the next billing period.

4.4 Cancellation

You may cancel your subscription at any time through your App Store or Google Play account settings. Upon cancellation, you retain access to paid features until the end of your current billing period. No refunds are provided for unused portions of a subscription period.

4.5 Credits

GoGlow may offer a credit system for individual portrait generations. Credits are non-refundable, non-transferable, and expire according to the terms displayed at purchase. Free credits expire as specified at the time they are granted.

4.6 Price Changes

GoGlow reserves the right to modify subscription prices. We will provide at least 30 days' notice before any price changes take effect for existing subscribers.

5. Intellectual Property

5.1 GoGlow's Property

The Service and its original content (excluding User Content), features, functionality, design, software, AI models, and branding are owned by GoGlow AI and its licensors and are protected by copyright, trademark, patent, and other intellectual property laws.

5.2 Trademarks

"GoGlow," the GoGlow logo, and related marks are trademarks or registered trademarks of GoGlow AI. You may not use these marks without our prior written permission.

5.3 Feedback

If you provide suggestions, ideas, or feedback about the Service ("Feedback"), you grant GoGlow a perpetual, irrevocable, royalty-free license to use that Feedback for any purpose without compensation to you.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information and photos.

7. Third-Party Services and Links

The Service may contain links to or integrate with third-party websites, services, or applications. These third-party services operate independently from GoGlow. We are not responsible for the content, privacy practices, or availability of third-party services. Your interactions with third-party services are governed by their own terms and policies.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, GOGLOW DISCLAIMS ALL WARRANTIES, INCLUDING:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, completeness, or reliability of any content generated by the AI
• Warranties that defects will be corrected

AI-generated content is creative in nature. GoGlow does not guarantee specific results from the AI generation process. The quality and accuracy of generated portraits may vary.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOGLOW AI AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

GOGLOW'S TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID GOGLOW IN THE 12 MONTHS PRIOR TO THE CLAIM OR $100 USD.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless GoGlow AI and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

11. Modifications to the Service and Terms

11.1 Service Changes

GoGlow reserves the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We will try to provide reasonable notice for significant changes but are not obligated to do so.

11.2 Terms Changes

We may revise these Terms from time to time. For material changes, we will notify you via email, in-app notification, or a prominent notice on our website. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Termination

GoGlow may terminate or suspend your access to the Service at any time for any reason, including if you violate these Terms. Upon termination:

• Your access to the Service will cease immediately
• You may lose access to your account, content, and purchased credits
• GoGlow is not obligated to provide refunds for unused subscription time
• Provisions of these Terms that should survive termination will remain in effect

You may terminate your account at any time by deleting it within the Application settings.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

13.1 Informal Resolution

Before initiating formal proceedings, please contact us at legal@goglow.ai to resolve the dispute informally. We will make reasonable efforts to resolve disputes within 30 days.

13.2 Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association. The arbitration shall take place in San Francisco, California, or via videoconference for claims under $10,000.

13.3 Class Action Waiver

To the fullest extent permitted by law, you waive the right to participate in class action lawsuits or class-wide arbitration against GoGlow.

13.4 Exceptions

Either party may seek emergency relief in court for matters involving intellectual property rights or imminent harm.

14. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy and EULA, constitute the entire agreement between you and GoGlow regarding the Service.
• Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
• No Waiver: Failure to enforce any right or provision shall not constitute a waiver.
• Assignment: You may not assign these Terms. GoGlow may assign them without restriction.
• Force Majeure: GoGlow is not liable for delays or failures caused by circumstances beyond its reasonable control.
• Language: These Terms are written in English. Any translations are provided for convenience only; the English version controls.
